SB 205: Business Licenses & Storm Water Discharge Compliance
On October 9, 2019, Governor Newsom signed Senate Bill (SB) 205 into law. It received bi-partisan support in both the Assembly and Senate.
What Does SB 205 Require?: Industrial facilities with a storm water permit are assigned a WDID (Waste Discharger Identification) number. Prior to the issuance or renewal of a business license, the WDID number will be checked by the city or county.
Will I Lose My Business License if I Don't Have a Storm Water Permit? Yes. In order to complete your business license application or renewal, you need to provide the city or county with your WDID permit number.
When Does SB 205 Take Effect? January 1, 2020. If the city or county does not issue a business license, SB 205 would not apply.
Does SB 205 Impact All Businesses? No. Just industrial facilities with a specific Standard Industrial Classification (SIC) code, as demonstrated in Attachment A. For metal facilities, your SIC is generally within the 3300s, 3400s and 5093. All of these codes require a storm water permit.
